User access to and use of the Site is subject to all applicable federal laws and regulations.

LIMITATION OF LIABILITY FOR SERVICES ARRANGED THROUGH THE SITE
You agree that ABStravels Limited is a mere agent for the providers of services available through the site, including but not limited to travel services. Any and all claims regarding any failure or breach with respect to the services offered through the site are limited to claims against any and all service providers. ABStravels Limited hereby disclaims any liability, whether based on contract, tort, strict liability, or otherwise, including without limitation liability for any direct, punitive, special, consequential, incidental our indirect damages, in connection with the goods or services provided by any carrier or other supplier through the site, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligent or otherwise, of such carrier or supplier and you hereby exonerate ABStravels Limited from any liability with respect to the same.
PRICES
Prices are quoted at the ruling daily exchange rate. Until the Travel Agent has received payment of the Price in full, it reserves the right to charge any fluctuations to the Client’s account and the Client undertakes to pay for any such fluctuation on demand. The onus will be on the Client to check that there have been no changes in the Price prior to making the full and final payment. Airfares are subject to the price and conditions quoted by the airlines. However, once payment of the Price in full has been received, the Price is guaranteed provided that the payment was made by midnight on the day that the Booking was made. Should the Client be a group booking and the group number deviates from the number required for the Booking, the Principal may reserve the right to re-cost the Price and raise a surcharge. Should any Client refuse to accept and pay such surcharge, it may result in the Principal canceling the Booking and refunding any payment made less the surcharge by the Agent and/or Principals (The Travel Agent will be entitled to retain any service fees charged).
LINKED INTERNET SITES
ABStravels Limited prohibits caching, unauthorized hypertext links to the Site, and the framing of any Content available through the Site. ABStravels Limited reserves the right to disable any unauthorized links or frames and specifically disclaims any responsibility for the Content available on any other Internet sites linked to the Site. Access to any other Internet sites linked to the Site is at the user’s own risk.
Users should be aware that Linked Sites may contain rules and regulations, privacy provisions, confidentiality provisions, the transmission of personal data provisions, and other provisions that differ from the provisions provided on the Site. ABStravels Limited is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.
The person requesting quotations or estimates or making a booking or to whom any services are rendered is deemed to have read and accepted the Conditions and to have the authority to do so on behalf of the person in whose name the estimate or quotation or reservation is requested and/or provided and/or the person to whom the services are rendered (collectively referred to as ‘the Client(s)).
SERVICE FEE
These fees cover the costs incurred by the Travel Agent in booking and servicing your travel reservation.
Responsibility and Hold Harmless
The Proposed Travel Arrangements are made on the express condition that the Travel Agent, its employees, and agents, shall not be responsible for, and shall be exempt from, all liability in respect of loss, damage, accident, injury, illness, harm, trauma, death, delay or inconvenience to any Client (which shall be deemed to include the heirs, executors, administrators or assigns of the Client), their luggage, or other property, wherever, whenever and however the same may occur. The Client indemnifies and holds harmless the Travel Agent, its employees, and agents accordingly. The Travel Agent, its employees, and agents shall furthermore not be liable for any indirect and/or consequential loss or damages whatsoever.
INSURANCE
It is strongly advised that all Clients take out adequate insurance cover in order to cover instances such as cancellation due to illness, accident or injury, personal accident and personal liability, loss of or damage to baggage and sports equipment. (Note that is not an exhaustive list). The Travel Agent will not be responsible or liable if the Client fails to take adequate insurance cover. It shall not be obligatory upon the Travel Agent to effect insurance for the Client except upon detailed instructions given in writing and all insurance effected by the Travel Agent pursuant to such instruction will be subject to such exceptions and conditions as may be imposed by the insurance company or underwriters accepting the risk. The Travel Agent shall not be obliged to obtain separate cover for any risks so excluded. Should the insurers dispute their liability for any reason, the Client will have recourse against the insurers only. Please note that various credit card companies may offer limited levels of travel insurance, which the Travel Agent does not consider sufficient cover for international travel. The Client is advised to check with their respective credit/debit card companies in order to obtain the specific details of the cover offered.
DISCLAIMER
Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).
However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Supplier as made available on our Platform, (iii) the services rendered or the products offered by the Supplier or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Supplier or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
INTELLECTUAL PROPERTY RIGHTS
Unless stated otherwise, the software required for our services or available on or used by our platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our platform are owned by abstravels limited limited, its suppliers, or providers.
